Warning
The purpose of this document is to alert customers that in the event of fraud, abuse, or non-payment due to a chargeback on a GPowerHost/Domain/SSL service or product all services will be discontinued without any further notice or hope of repair.
Wrongly Initiated Chargebacks
Goods and services must be paid for. If a customer has an issue with our service they are required to follow our Complaint Procedure. We promise to resolve the issue and credit a customer back any funds we agree they are owed. Credit card companies and payment processors like Paypal require customers to contact the seller to first attempt resolution. Even if a customer is rightly owed money, the correct and civil way to proceed is to formally ask for a refund from the seller. A chargeback is considered Wrongly Initiated when a customer does not follow our complaint resolution policy which affords GPowerHost a means of resolving and refunding the customer through proper channels.
Loss and Locking of Services
If a customer wrongly initiates a chargeback on a GPowerHost/Domain/SSL service or product the product or service will be cancelled and the customer will no longer have access to any control panels and any associated websites will be taken down. Any SSL certificates held through us will be permanently revoked. Any domain name held through us will be banned and placed in redemptive, restrictive lock.
To release a banned domain name, other product or service a customer must:
- Reverse the chargeback (we will not accept additional payment for services on a different card)
- Pay a $150 release fee
- Pay any past due or other owed amounts
- Sign an agreement preventing further chargebacks and misuse of our products or services
Release fees accrue interest at the maximum rate allowed by law, or 26% Annual Percentage Rate (whichever is higher).
Canceling a Chargeback or Dispute
In the event that a customer decides to follow our our Complaint Procedure after a chargeback or credit card dispute has been filed.
To cancel a chargeback, you must contact your credit card provider and issue a chargeback reversal. To cancel an open dispute you must contact the online payment processor and close your dispute.
Reporting
Fraudulent chargebacks may be turned over to a law enforcement or collection agency.
AUP/Spam Violations and Complaints
Simple abuse complaints or list removal requests are routinely processed by GPowerHost at no additional charge, with the appropriate, active hosting package in good standing. However, if you get a lot of complaints or the complaints are serious and the resolution of such takes more than a few minutes, cumulatively per month, you will need to purchase support time. Each hosting package specifies how much free email support you get and the rates and plans available for additional support.
In the event of an AUP or Anti-Spam Policy violation or serious complaint, customer shall pay GPowerHost $150 per hour for administrative time incurred in answering complaints, preparing affidavits, and researching the source of spam. In addition, the customer shall pay GPowerHost a recovery fee of $1 for every piece of spam sent.
Customers that have a previous spam complaint, are required to post a bond with GPowerHost equivalent to $1 per email address stored on the server, to be applied against any fees that may be assessed for future violations. Failure to pay fees or post bond payment shall result in the immediate forfeiture of any remaining service, funds to be applied against fees, followed by termination and deletion of their account.
